FMCSA Puts Their Foot Down on ‘Weed’

A number of states are now beginning to open the path for using marijuana for recreational purposes. However, the latest Moving Industry News says that new federal law is curbing truckers from using the ‘Weed.’ The Federal Motor Carrier Safety Administration or FMCSA received several inquiries with regard to federal laws around trucking after the new state laws became active in Washington and Colorado.

According to the Director-Office of Drug and Alcohol Policy and Compliance, any curb on marijuana restrictions in states don’t affect the drug-testing program created by the Department of Transport. The Director stated this in a notice published on the website of the agency.

Part 40 of the Drug and Alcohol Testing Regulation No. 49 CFR bars the use of drugs that include marijuana. According to the notice, medical review officers wouldn’t change tests to negative for drivers using “recreational marijuana” even if any state passes a new law. Even if a driver uses “medical marijuana” the officers wouldn’t consider the test as negative.
